Real Estate Counsel – Renewable Energy

Houston, TX | Full-Time | Flexible Hybrid

Solar | Battery Storage | Project Development | Real Estate Law

Brightsmith has partnered with a high-growth independent power producer and top community solar developer to identify a Real Estate Counsel to support their rapidly expanding portfolio of solar and battery energy storage (BESS) projects across the U.S.

This vertically integrated renewable energy company develops, owns, and operates distributed energy assets for commercial, industrial, and community customers. With proprietary technology, deep industry expertise, and a strong capital base, they are streamlining how clean energy is developed and financed.

As the company scales, this Real Estate Counsel will serve as a key legal partner to the development, finance, and capital markets teams—guiding land acquisition, due diligence, site control, and project closings across the lifecycle of distributed energy projects.

What You’ll Do

  • Negotiate, draft, and manage rooftop and ground lease agreements, easements, options, and other real estate documents.
  • Conduct title and survey reviews; lead and support curative efforts tied to development, financing, or construction milestones.
  • Collaborate with development and capital markets teams to manage real estate deliverables for project financing and M&A transactions.
  • Support diligence and closings across project finance, including tax equity and third-party acquisitions.
  • Provide legal oversight on permitting, interconnection, and site control throughout development.
  • Respond to due diligence requests, coordinate with outside counsel, and ensure real estate compliance across internal and external stakeholders.
  • Track, review, and manage contract obligations through all stages of development and construction.

What You Bring

  • J.D. from an ABA-accredited law school and active license to practice law in at least one U.S. jurisdiction.
  • 4+ years of legal experience in commercial real estate; renewable energy experience strongly preferred.
  • Proven ability to review, negotiate, and manage site control documents, title policies, surveys, and curative work.
  • Strong communication, organization, and cross-functional collaboration skills.
  • Ability to juggle multiple projects and timelines in a high-growth, fast-paced environment.
  • Comfortable working independently while providing practical, business-minded legal advice.
